The medical marijuana issue did not end with the vote. There are rules and regulations to put in place and the State Health Department is at the center of controversy regarding those rules. Not only did the rules come out pretty quickly, prompting many to ask whether something was amiss and demand proper procedure be followed, but the Department made more headlines when attorney Julie Ezell admitted to sending herself threatening emails. To be clear, the process of developing and implementing rules and regulations for use of medicinal marijuana should follow a certain path, and recent events beg the question of whether that path was straight. Rulemaking procedure should involve drafting proposals, a notice period for comment, and then finalization. While the story continues to unravel, the State waits with anticipation to see whether this is what happened or if something else was at work behind the scenes.
