GOVERNOR APPROVES CHANGES TO DUI LAWS: WHAT DOES THE NEW LAW DO?
Prior to the passing of Senate Bill 643 those suspected of DUI were not required to take a breath test. But on November 1, 2017 when this new law goes into effect, that will no longer be the law. One of the most damaging parts of this law is that for those that refuse the test, jail time will be mandatory. The problem with this punishment is that a breath test result is evidence of intoxication (or not), and because it is the defendant that takes the test, the results are the equivalent of the defendant actually testifying against themselves. And as we all know, or have at least probably heard, the Constitution of both the U.S. and of the State of Oklahoma, allows defendants to refrain from giving testimony against themselves.
