FORMER STATE DEPT. OF HEALTH ATTORNEY FILES SUIT CHALLENGING MEDICAL MARIJUANA BILL

A lawsuit has been filed by an attorney who was the center of an investigation regarding regulation of Oklahoma’s medical marijuana industry. The lawsuit claims a bill signed in early March is unconstitutional because it is not specific enough regarding the powers held by the State Health Department when it comes to disciplinary powers. Specifically, the lawsuit alleges the Department is given blanket authority to take action against a medical marijuana license holder by allowing action for “any other basis” the Health Department identifies. The suit is pending, but its outcome will be important for those in the industry.
