The 2017 Impaired Driving Elimination Act 2 has been held unconstitutional by the State Supreme Court. The reason? The bill did not limit itself to just issues of DUI, and thus violated the “single subject” rule. This is good news for Oklahoma drivers, because the new law would have deprived drivers the right to fight a DUI related license suspension through administrative channels, and would also have made it against the law for a driver to refuse a breath test.
