LEGISLATORS LOOK AT RECLASSIFYING CERTAIN CRIMES

It is no secret that the state’s elected officials consider a number of changes to the law while in session, and that many of those have to do with the criminal justice system. We have seen a new law regarding left hand lane driving go into effect, have heard about possible changes to what types of crimes are defined as misdemeanors versus felonies, and are always on the lookout for changes to the DUI laws. The legislature is now considering a third classification for the crime of burglary, and a person could face burglary charges if they break into a car, boat, or trailer with the intent to steal. This third classification of burglary does include the requirement that the breaking and entering be done with the intent to steal, and simply smashing windows or breaking in to a car or boat for shelter would not qualify. There must be some intent to commit another crime once inside. Possible punishment for this third degree burglary charge is up to five years, but no more, imprisonment. The proposal also makes other changes to the current law and as these changes take place we will keep our clients informed and up to date so you know what to expect when facing criminal charges.
