What is Expungement? It’s the sealing of your records from the public. This does not apply to law enforcement or administrative government agencies and only the court record is sealed.
How do I get an arrest expunged? By petitioning the District Court (or the Municipal Court) in the district where the arrest was made.
Do I need a lawyer? Expunging your record is a complicated and sensitive matter. Most people dealing with expungements recommend you hire a lawyer. If you want to know more, read Title 22, Section 18 and Title 22 991(c) of the Oklahoma Statutes.
There are two types of Expungements: Section 991 (c): allowing the person who received a deferred sentence to expunge their plea and update their case to show “not guilty, case dismissed.” Understand that the expungement will not remove the arrest record and only the court record is sealed.
Section 18: allows for the person to expunge their ENTIRE arrest record.
