GOVERNOR APPROVES CHANGES TO DUI LAWS: WHERE DO WE GO NEXT?

Once this law becomes effective we will all need to be vigilant in how it is applied. It is crucial to safeguard the constitutional rights of every citizen, but we also have to make sure the laws approved by our Legislature are properly applied. The law does include severe punishments for refusal to take a breath test, but also gives defendants the right to participate in a DPS Driver Accountability Program and have an interlock device installed in their car, or have the Court decide whether a DUI charge should stick. There are consequences to this bill that may not have been intended, yet they exist. Until there are some cases before the Court, it will be hard to say what approach will work best if you are charged with DUI. But rest assured we are continuing to follow this issue, and will report back on any updates up until the time of implementation on November 1, 2017.
