WHAT IS PAIN AND SUFFERING?

If you have been in an accident the negligent party can be held liable for your costs, and may also have to pay for any pain and suffering. The medical costs are economic damages, while pain and suffering are non-economic. In many cases with large jury awards, the biggest portion of the amount awarded is classified as non-economic. These figures have been capped, but in a recent case the Oklahoma State Supreme Court held the cap on these damages is unconstitutional. It is possible the legislature may take up the issue, because there are strong opinions on both sides of the fence when it comes to deciding whether monetary damages should be limited to a certain amount.
